Clubs & Community GroupsAn informal club or community group (unincorporated association) is not recognised as a separate legal entity to the members associated with it. It is a group of people who agree to act together as an organisation and form an association. The group can remain informal and its members make their own constitution or rules on how the group is managed.

The disadvantage is that if anything goes wrong and someone decides to sue, it's possible that individual members be held personally liable. In that case, if the club or community group doesn’t have the funds to cover the payout you may have to pay for it yourself.

There can also be difficulties with opening bank accounts and getting insurance, confusion about who owns what property and most foundations and government departments will only fund organisations that are a legal entity.

An incorporated association is a legal entity separate from its individual members, has rules of incorporated association and can continue regardless of changes to membership. It also provides financial protection by usually limiting personal liability to outstanding membership and subscription fees, or to a guarantee.
